Texas State & Local Tax Law Blog: If software works right out of the box, it's a taxable computer program

Verizon North is an important judicial interpretation of when software is or isn’t a “computer program” and taxable at the time of purchase. That interpretation is especially important to so-called “enterprise software” that often requires extensive – and expensive – post-purchase customization before it can be used as intended. For that reason, Texas businesses should carefully review the Verizon North opinion with their state tax counsel before attempting to claim that the software that they’re planning to buy – or that they’ve purchased in the past – isn’t subject to Texas sales and use tax.

I argued this case in May, winning for the State.

Surprise in the Pool

Yesterday was a blast. I got home from work and found Tara and the two youngest in the pool. After a quick change, I crept around the house and waited until Tara and the kids were looking the other way. Then, I ran and jumped in between them. The look on their faces will last a lifetime.

Pool Boots Kids Who Might "Change the Complexion" | NBC Philadelphia

>"When the minority children got in the pool all of the Caucasian children immediately exited the pool," Horace Gibson, parent of a day camp child, wrote in an email. "The pool attendants came and told the black children that they did not allow minorities in the club and needed the children to leave immediately."

>The next day the club told the camp director that the camp's membership was being suspended and their money would be refunded.

Not too bright.

In Russia, Obama’s Star Power Does Not Translate - NYTimes.com

Let other capitals go all weak-kneed when President Obama visits. Moscow has greeted Mr. Obama, who on Tuesday night concluded a two-day Russian-American summit meeting, as if he were just another dignitary passing through.

Obama isn't getting the bended knee in Russia. Go figure.
